In the local DC reports there's also confusion about the fatalities. The initial reports made it sound like it was passengers on the train, but there are conflicting reports that it was two people trying to move the backhoe who were killed. The Times report has a lot more detail also.
The stores read about a 'backhoe', yet some of the photos show a large yellow LORAM track surfacing machine in the area. Not sure if this is what the media is calling a 'backhoe', but they wouldn't know the difference. Hard to say what's up at this point. I hope this wasn't some sort of dispatching/track warrant error. The two ATK people who died were seasoned, long term employees. Very sad.
