County gives SK&O 30 days to repair tracks

Cowley County Attorney Chris Smith has requested Southern Kansas & Oklahoma Railroad repair the crossings at New Salem.
The request was mailed Tuesday and includes a notice that the repairs need to be complete within 30 days or "appropriate legal action may be commenced as allowed by Kansas Statutes," Smith's letter states.
The Cowley County commission has received numerous complaints about one crossing in particular. They agreed at the Aug. 14 meeting to begin legal proceedings against the railroad.
"The main non-compliance results from several deep pot-holes that have developed adjacent to and in between the steel rails," Smith wrote in his letter.
In addition, County Engineer Dale Steward inspected the crossings and found the vertical alignments are out of compliance, according to the letter.
Commissioners were updated on Smith's actions during a short meeting Tuesday night.
